..for KMC The Court: Two appeals are taken up for consideration analogously as they involve the same issue.
Both the appeals are directed against the order dated May 3, 2023 passed in two writ petitions namely, WPO 611 of 2015 and WPO 381 of 2023. By the impugned order learned Single Judge dismissed two applications of the appellant seeking impleadment in the writ petition.
Court is informed that there is a revisional application pending concerning the private parties.
None appears for the appellant.
Records placed before the Court suggests that the two writ petitions require disposal finally. One writ petition is pending since 2015 and the other is pending since 2023.
In the two writ petitions, appellant applied for impleadment. Without prejudice to the rights and contentions of the respective parties as to the prayer for impleadment of the appellant before us in the two writ petitions, parties are permitted to request the learned Single Judge to hear and dispose of the writ petition finally after hearing the parties to the writ petition including the persons seeking impleadment in the writ petition. Learned Single Judge will decide the issue of impleadment of the appellant in the writ petition, as one of the issues while deciding the writ petition finally. Impugned order dated May 3, 2023 is modified to that extent. APOT 167 of 2023 and APOT 166 of 2023 along with all connected applications are disposed of without any order as to costs.
