It is submitted by the learned counsel for the respective parties that the disputes between the parties have been settled and Terms of Settlement has been entered between the parties. The plaintiff has filed the present suit praying for recovery of an amount of Rs.30,00,000/- along with interest at the rate of 15% per annum. After the negotiation between the parties, the matter has been settled on the terms that the defendant will pay Rs.10,00,000/- being the full and final

settlement and the plaintiff will accept the said amount being the full and final settlement.

Accordingly, learned Advocate appearing on behalf of the defendant has handed over a Demand Draft of Rs.10,00,000/- to the learned Advocate appearing for the plaintiff being No.309659 dated 3rd January, 2025 of HDFC Stephen House Branch and the learned Advocate for the plaintiff has accepted the same.

As the parties have settled their disputes and have entered into a Terms of Settlement and in terms of the settlement, the defendant has paid the total settlement amount of Rs.10,00,000/- to the plaintiff, thus, CSCOM/765/2024 is disposed of. Decree be drawn accordingly. The Terms of Settlement filed by the parties be treated as part of the decree.

Consequently, interlocutory applications, if any, also disposed of. Photocopy of the Demand Draft be kept with the record. (KRISHNA RAO, J.) RS
