1. Counsel for the plaintiff submits that after going through the pleadings, the plaintiff found that there are several technical defects in the plaint and as such the plaintiff intends to withdraw the suit with liberty to file afresh.

2. In view of the submission made by the counsel for the plaintiff, the plaintiff is allowed to withdraw the suit with liberty to file afresh.

3. As the plaint has not been admitted, accordingly, the department is directed to refund the court fee and the plaintiff is at liberty to use the said court fee if the plaintiff intends to file a fresh suit in future.

4. CS-COM/122/2025 is dismissed as withdrawn with liberty to file afresh.
