1. Report of the Special Officer filed in Court today dated 26th February, 2026 is taken on record.

2. Learned advocate for the petitioner submits that she has instruction to withdraw the writ petition.

3. Noting that the above is not objected to by the learned advocates representing the respondents, however, considering the fact that

the petitioner had approached this Court complaining illegal construction, and precious time of this Court having been consumed to adjudicate the same, and now since it is claimed that the disputes have been settled, without going into such issue, and without in any way impinging on the rights of the municipality, the writ petition stands dismissed as withdrawn subject to payment of costs of Rs.2 lakhs to be paid by the petitioner to the Calcutta High Court Legal Services Committee.

4. Let the original records retained in a sealed cover be returned to Mr. Das, learned advocate representing the municipality against the receipt to be retained in the file, on the petitioner providing the receipt for payment of cost which shall be retained in the file.

5. Let it be recorded and as submitted by the parties the remuneration of the Special Officer has already been paid. Accordingly, since the parties are not proceeding with the matter, the Special Officer stands discharged.
