The Court :- This is an application for grant of probate of the last Will and Testament dated 17th October, 2018 left behind by the abovenamed deceased.

The testatrix was a widow and issueless at the time of death. The only immovable property being the subject matter of the Will has been received by the testatrix from her husband as clearly stated in the Will. The heirs in intestacy of the testatrix, therefore, are the heirs of her husband. There are four nephews of the husband of the testatrix. One of them is the applicant, the other three have given consent to the grant of probate. Considering the view of the department upon complete scrutiny, the application for grant of probate is allowed by granting order in terms of prayer (a) of the petition.

The petition for grant of probate stands disposed of, accordingly. (ARINDAM MUKHERJEE, J.) snn
