Mr. Prasenjit De, Mr. Priyabrata Thakur, Advocates for the petitioner. The Court :- This is an application for grant of probate of the last Will and Testament dated 29th September, 2023 left behind by the abovenamed deceased.

The mother and the wife of the testator had predeceased him. The testator had no children. The properties, therefore, in case of intestacy would devolve unto the Class II heirs in accordance with the provisions of Section 8 of the Indian Succession Act, 1956 read with the Schedule thereunder written. All the Class II heirs except one sister have predeceased the testator. The surviving sister has consented to the grant. The Will has been proved in common form by the affidavit of the attesting witness.

Considering the view of the department upon complete scrutiny, the application for grant of probate is allowed by granting order in terms of prayer (a) of the petition.
