The Court: Despite service, none appears for the respondent. The affidavit of service filed today be kept on record.

Learned counsel for the petitioner points out from a communication dated February 7, 2023 that an Arbitrator was appointed on consent of the parties, who took up the arbitral reference. However, the mandate of the Arbitrator expired on July 6, 2024. It is submitted that in view of the pleadings being voluminous, a further extension of twelve months be granted. It transpires from the materials before the Court that there is substance in the contention of the petitioner.

Accordingly, AP-COM 795 of 2024 is allowed, thereby extending the mandate of the learned Arbitrator taking up the arbitral proceeding between the

parties for a further period of twelve months from this date. It is made clear that the said extension shall be deemed to operate on and from July 6, 2024. (SABYASACHI BHATTACHARYYA, J.) SP/
