The Court:- Despite service, the petitioner is not represented. Affidavit of service filed in Court is taken on record.

The petitioner is aggrieved that 15 adjournments have been allowed by the National Company Law Tribunal, Kolkata, in IA No. 841/KB/2020 and IA No. 1288/KB/2020. The delay in disposal of the proceeding has caused huge loss to the petitioner.

It is submitted that adjournments are being granted despite urgency having been pleaded by the petitioner and recorded by the Tribunal. Such recording is evident in the copies of the orders of the tribunal annexed to the writ petition.

Without going into the allegations behind the reasons for adjournment, this Court directs the National Company Law Tribunal at Kolkata Bench to mandatorily and positively dispose of the IA (IBC) 841 of 2020 and 1288 of 2020, on the 23rd of May, 2022 when the matter is fixed next. If the hearing continues beyond 23rd May, 2022, it shall be taken up on a day-to-day basis and disposed of by a reasoned and pronounced order within a period of seven days thereafter.
