The Court: This is an application after the grant of probate to the last Will and Testament dated 9th September, 2006 left behind by the deceased. The grant has been allowed by an order dated 26th April, 2024 but the same has not been issued till date.

In this application, the executor in whose favour the grant has been made is seeking amendment of the address of the immovable property as shown in the affidavit of assets filed in the probate proceedings. It is the case of the executor that after the grant was allowed he has been informed that the address of the immovable property should be '48B, Sastitala Road, Post Office and Police Station -Narkeldanga, Kolkata - 700 011' instead of '48, Sastitala Road'. The amendment as shown in red ink in a copy of the affidavit of assets

annexed to this application as Annexure 'E' thereto is allowed. The affidavit of assets shall be corrected by replacing '48, Sastitala Road' by '48B, Sastitala Road'. The department shall carry out the amendment within a period of fortnight from date. It is made clear that on the amendment being carried out, the applicant shall have the liberty to re-affirm the affidavit of assets. The testamentary department while issuing the grant shall take into account the amended address of the immovable property.
