...for the petitioner in WPA 2206 of 2024 & respondent no.6 in WPO 818 of 2024 The Court:- This Court, by order dated 20th September, 2024 has passed an interim order against the respondent, Union of India. The Union of India has approached the Hon'ble Division Bench against the said order. In IA NO. GA/1/2024 in APOT/396/2024, the Hon'ble Division Bench, in the order dated December 4, 2024 has, inter alia, observed that :-

23) In those circumstances, this Court is of the view that the writ petitions are premature. There is no illegality demonstrated in issuance of the impugned order. The question of entertaining the writ petitions could not have arisen. The single Bench, in the opinion of this Court, far from passing any interim order, should have dismissed the writ petitions as premature.

24) This Court, therefore, dismisses the two writ petitions being WPA 22062 of 2024 and WPO 818 of 2024. The impugned order also stands set aside.

It appears from the said observations of the Hon'ble Division Bench that the Appellate Court has held that the writ petitions are premature and by the said order the Hon'ble Division Bench was pleased to dismiss the writ petitions.

Following the order of the Hon'ble Division Bench as mentioned earlier, the instant writ petitions cannot be proceed further. Accordingly, the writ petitions are disposed of with the observation made above. (SUBHENDU SAMANTA, J.) S.A.
