The Court: This is an application for substitution of the erstwhile Arbitrator who was appointed by the parties.

Learned counsel appearing for the petitioner places a letter dated 25th April, 2023 where the learned Arbitrator has sought to retire from the proceedings on the ground of personal difficulties. The records also show that two arbitration sittings were held before the Arbitrator retired from the proceedings.

The respondents were represented on the last four occasions. However, no one appears today on behalf of the respondents.

AP/377/2023 is accordingly allowed and disposed of by appointing Mr. Swarajit Dey, counsel to act as the Arbitrator in place and stead of the erstwhile Arbitrator subject to the learned Arbitrator communicating his/her consent in the prescribed format to the Registrar, Original Side within three weeks from date.

The Arbitrator appointed will resume the proceedings from the stage at which the earlier proceedings were left incomplete. This order shall be communicated on the learned Arbitrator within 22nd September, 2023 along with all relevant details of the contact person of the petitioner.
