The Court:-The matter is being taken out of turn upon being mentioned by learned Senior Counsel appearing for the appellant. It is contended that the petitioner seeks to withdraw the present application under Section 9 of the Arbitration and Conciliation Act, 1996 in view of an undertakingto similar effecthaving been given before a different Bench where a fresh application under the same provision has been filed.
