Mr. Partho Proteem Das, Adv. ...for respondent. The Court :- Affidavit of service filed in court today is taken on record. As Mr. Guhathakurta, learned Advocate appearing for the respondent submits, on instruction, that no further steps will be taken in respect of the vehicle and the order passed in the appeal shall be honoured, the application is disposed of by recording such observation. The erstwhile arbitrator has resigned. The parties are at liberty to take steps for appointment of an arbitrator and all other interim reliefs and prayers that are available shall be made before the newly appointed learned arbitrator.

On recording the submission made by the respondent, this Court does not deem it necessary to pass any other interim order at this stage as the vehicle is protected and the Court has already restrained alienation and/or change of nature and character of the concerned vehicle.

Accordingly, this application is disposed of. Liberty is granted to the respondent to file Vakalatnama within a week from date.
