1. The petitioner has raised certain allegations before the competent authority under the West Bengal Apartment Ownership Act, 1972.

2. Learned advocate representing the Association has produced before this Court a communication dated 4th September, 2025 by the Special Commissioner and the competent authority under the Act addressed to the President of the Association seeking a reply to the complaint filed by the legal representative of the petitioner. Fifteen days' time has been allowed for filing the reply.

3. As it appears that the competent authority has already taken steps in response to the complaint filed by the petitioner, accordingly, the instant writ petition is disposed of by directing the competent authority to take steps in the matter strictly in accordance with law and dispose of the complaint filed by the petitioner at the earliest but positively by 26th September, 2025, after giving a reasonable opportunity of hearing to all the necessary parties by passing a reasoned order.

4. It is made clear that in the meantime the Association shall not force any flat owner to pay any charge on account of cultural activity. Any amount collected by the Association as charges for cultural activity shall abide by the order passed by the competent authority after hearing the parties.

5. Writ petition stands disposed of.
