The Court: Affidavit of service filed in Court today is taken on record. The petitioner alleges that the direction given in the interim award of the learned Arbitrator dated August 10, 2024, directing the CPWD to remove the name of the petitioner from the list of debarred contractors appearing in the website of CPWD, has not been complied with. This Court is of the view that non-compliance of such direction of the learned Arbitrator can be raised before the learned Arbitrator and the learned Arbitrator has the jurisdiction to pass necessary orders. The proceedings are still pending before the learned Arbitrator and the petitioner is at liberty to take appropriate steps in this regard. If such step is taken, the learned Arbitrator will pass necessary orders as he deems fit and proper. Needless to mention,

such decision shall be taken by the Arbitrator within a period of two weeks from making the application. The petitioner may also pray before the Arbitrator to bring forward the date of sitting, so that the matter can be heard. All parties to act on a server copy of this order. (SHAMPA SARKAR, J.) A/s.
