The Court :- This is an application for grant of probate of the last Will and Testament dated 26th October, 2021 left behind by the abovenamed deceased.

The sole executor, namely, Ram Chandra Mukherjee being the only beneficiary under the last Will and Testament dated 26th October, 2021 left behind by the abovenamed deceased has filed an affidavit to the extent that to secure the interest of his minor son being the grand son of the testatrix, he shall deposit the entire sale proceeds derived out of the money available by developing the immovable property of the deceased bequeathed under the Will by way of fixed deposit in the most favourable scheme with any nationalized bank for the period till the minor son on whose behalf he has consented to the grant as the father and natural guardian attains majority. The undertaking also provides that upon the minor son attaining majority will be exclusively entitled to use the sale proceeds in entirety for his own use.

In view of such undertaking the interest of the minor on whose behalf of the executor in the capacity of the father is consenting to the grant appears to be protected.

Let probate of the last Will and Testament dated 26th October, 2021 left behind by the abovenamed deceased be granted to the petitioner/applicant in terms prayer [a].

PLA/264/2022 is accordingly disposed of.
