The present petition has been filed in effect for a direction upon the respondent no. 3 to withdraw and/or rescind the portion of the order dated 7th April, 2025 which withholds the grant of the mutation in favour of the petitioner no. 1.

Records would reveal that the petitioners claiming interest in municipal premises no. 76, Christopher Road, Kolkata - 700046 had applied for mutation. Although the petitioners' application was processed, however, by an order dated 7th April, 2025 in order to test out the title deed of the petitioners as regards its authenticity, an information was sought for from the Additional IGR and Additional CSR (Registration, West Bengal).

Today, Mr. Ghosh learned advocate representing the Kolkata Municipal Corporation by placing before this Court an instruction sheet has submitted that an email communication has been received from the office of the District Registrar, South 24-Parganas confirming that the deed in question seems to be genuine. Mr. Ghosh would submit that the municipal authorities are taking steps for further processing of the petitioners' application in accordance with law.

Having regard to the submissions made in Court today, I am of the view that no fruitful purpose would be served by keeping the writ petition pending.

The writ petition being WPO/681/2025, accordingly, stands disposed of with a direction upon the Municipal Authorities to ensure early processing of the petitioners' mutation application preferably, within six weeks from the date of communication of this order. (RAJA BASU CHOWDHURY, J.) Arsad
