The Court : By the order dated 17th February, 2020 the submission of Mr. Ghosh, learned advocate for the appellants was recorded. It was to the effect that the appellant no.1 had died.

We adjourned the appeal to enable learned counsel to take appropriate steps in the matter.

None appears for the appellants. We presume that no steps have been taken to formally record the death of the appellant no.1 and to substitute his legal heirs and representatives in his place, if such right was available to the applicant in law.

In those circumstances, the appeal has abated as against the appellant no.1 and is hereby dismissed.

None appears for the appellant no.2. It is also dismissed for nonprosecution against the appellant no.2. Interim order, if any, is vacated.
