The Court : Mr. Javed Majid, learned Advocate, is appearing for the petitioner.

The petitioner has filed the present application for grant of Letters of Administration of the estate of the deceased Som Nath Ghosh. Counsel for the petitioner submits that the deceased died on 27th December, 1998 leaving behind his wife Arundhati Ghosh, his son Indrajit Ghosh and the petitioner being the daughter. Counsel for the petitioner further submits that the wife of the deceased died on 9th February, 2017 leaving behind the son Indrajit Ghosh and the daughter Antara Ghosh. Now, the daughter Antara Ghosh has filed the petition for grant of Letters of Administration. The son Indrajit Ghosh has affirmed his affidavit stating that he has no objection for issuance of Letters of Administration to the petitioner with respect of the estate of the deceased. Heard learned counsel for the petitioner.

Perused the application, death certificate of the deceased Som Nath Ghosh, death certificate of his wife Arundhati Ghosh and affidavit of consent of son Indrajit Ghosh.

This Court finds that the son has given his no objection for grant of Letters of Administration to the petitioner. Accordingly, this Court finds that the petitioner is entitled to get the Letters of Administration to the estate of the deceased.

The Department is directed to issue Letters of Administration of the property and credits of the deceased to the petitioner throughout the State of West Bengal upon furnishing bond of Rs.4 lacs with one surety. The Department is also directed not to draw and complete the order. Accordingly, PLA No. 220 of 2023 is disposed of. (KRISHNA RAO, J.) KB ARCR
