The Court : The learned Counsel for the petitioner namely Manuel Rozario has submitted that special citation as well as general citation were done in respect of Samuel Rozario and Antonia Shaw. Nothing was heard from Samuel Rozario in spite of citation. Antonia Shaw filed caveat but as she did not file any affidavit in support of caveat, the same has been discharged. The other son of the deceased namely Xavier Rozario has submitted affidavit of consent. As such there is no impediment to allow the prayer (d) of the relevant petition.

I have considered the affidavit of consent and other materials on records including the report of the Registrar-in-Insolvency, High Court, Original Side dated 23.11.2023.

In view of the above, let there be an order in terms of prayer (d). In fine, the matter stands disposed of.
