Md. Saidul Haque v. The State Of West Bengal And 3 Others
OD-1 W.P.O. No. 634 of 2019
IN THE HIGH COURT AT CALCUTTA
Constitutional Writ Jurisdiction ORIGINAL SIDE (VIA VIDEO CONFERENCE) MD. SAIDUL HAQUE
Versus
THE STATE OF WEST BENGAL AND 3 OTHERS
BEFORE:
The Hon'ble JUSTICE ABHIJIT GANGOPADHYAY Date : 21st January, 2021.
Appearance :
Mr. Sk. Samim Akhter, Adv.
...for the petitioner The Court: The learned Advocate appearing for the petitioner makes a very innocuous prayer. He prays that his representation made to the State Transport Authority, West Bengal and to its Chairman and Secretary dated 14th February, 2019 is required to be heard and decided. His grievance is that he prayed for curtailment of the length of a route which permission has not been granted to him despite his efforts till date. He further submits that under Section 80 (3) of the Motor Vehicles Act such curtailment is permissible. After hearing the submission of the parties, I find that nobody will be prejudiced if this demand notice received by the State Transport Authority on 25th June, 2019 is considered, after granting an opportunity of hearing to the
petitioner, within a period of two months from the date of communication of this order.
With the above direction the writ petition is disposed of. Despite service nobody has appeared for the respondent authorities, however, this order passed in their absence will not cause any prejudice to the respondent authorities.
