...for the respondent The Court: Leave is granted to the learned advocate-on-record of the petitioner to correct the description of the application as one under Section 29A(4). The petitioner prays for extension of the mandate of the learned Arbitrator. Prayer for extension has been made on the ground that some time was consumed in filing the statement of defence. Although the parties agreed to a fast track procedure, the statement of defence is yet to be filed. Mr. Sen, learned senior advocate also submits that for the ends of justice prayer for extension of the mandate of the learned arbitrator be allowed. Mr. Dipanjan Roy, learned advocate for the respondent does not oppose such prayer for extension of the mandate of the learned Arbitrator who has been appointed to adjudicate the dispute between the parties on any ground.

Under such circumstances, the application is disposed of by extending the time of the learned Arbitrator to make and publish the award within a period of four months from the date of communication of this order. (SHAMPA SARKAR, J.) B.Pal
