The Court: The impugned award dated 25th April, 2011 has given raise to three proceedings. The first is an application for setting aside of the award by the petitioner assail in AP No.539 of 2011; the second is an application for setting aside of the award by the respondents G.S. Atwal in AP NO.694 of 2011 and the third is an execution proceeding taken out by G.S. Atwal which is EC No.119 of 2022.

The respondent in AP No.539 of 2011/ G.S. Atwal submits that the respondent will not proceed with the section 34 application being AP No.694 of 2011 and will instead proceed with the execution. G.S. Atwal was the claimant in the arbitration and was awarded 4 out of the 6 claims.

G.S. Atwal in AP No.539 of 2011 does not wish to file any affidavits in the proceedings.

List these matters i.e. EC/119/2022 and AP/539/2011 on 27th June, 2023.

AP/694/2011 is dismissed as not pressed.
