The Court: This is an application for recording the Terms of Settlement by and between the parties. It is submitted on behalf of the petitioner that pursuant to the award dated 19th February, 2014 the parties have amicably resolved their disputes. The respondent is represented and does not object to the aforesaid submissions made on behalf of the petitioner. In view of the aforesaid, there will be an order in terms of prayer (a) and (b) of the Notice of Motion. Insofar as prayer (c) of the Notice of Motion is concerned, the Registrar, Original Side, High Court Calcutta is directed to encash the fixed deposit made by the petitioner of a sum of Rs.4 crores pursuant to the order dated 4th March, 2020 and to hand over the same including the interest

component to National Highways Authority of India. Thereafter, the parties are directed to act in terms of the Terms of Settlement. In view of the aforesaid directions, IA NO. GA No. 5 of 2021 stands disposed of. AP No. 951 of 2014 is also treated on the Day's List by consent of the parties and is disposed of accordingly.
