This present writ petition has been filed inter alia praying for a direction upon the respondent no. 2 to act in accordance with the circular no. 60 of 2024 dated 30th March, 2024 and to issue a show cause notice to the respondent nos. 5 and 6 as to why their empanelment would not be cancelled and/ or terminated for non-compliance of the circular no. 60 of 2023-24. 2.

Respondent nos. 5 and 6 are not represented before this Court today.

The petitioner would complain that the respondent nos. 5 and 6 are not discharging their duties appropriately and the construction that is coming up under their supervision concerning the petitioner's property at B/1/H/6, Taltala Bazar Street, Ward No.53, Borough VI, Kolkata (in short the said property) is not in accordance with the sanctioned building plan. 4.

The municipal authorities have however filed a report before this Court dated 22nd September, 2025 and have claimed that on the basis of the

inspection carried out by the municipal authorities, the building that is coming up at the said property is in accordance with the sanctioned building plan. No unauthorised construction was found till the date of making such inspection and that the construction is going on under the supervision of the empanelled structural engineer.

Considering the peculiar facts noted above, I am of the view that no interference is called for at this stage.
