1. None appears for the appellant to press the appeal. Ms. Manasi Mukherjee, learned counsel for the respondent is present.

2. We have perused the impugned order dated 28.8.2017 in Misc. Application No.E/MA(ROA)-75251/2017 in Appeal No.E/317/11 passed by the Customs, Excise and Service Tax Appellate Tribunal, East Regional Bench, Kolkata whereby the application for recalling of the order dated 22.3.2017 was rejected by the Tribunal.

3. Perusal of the impugned order shows that the appeal was withdrawn by counsel after arguments were heard at some length.

4. In view of the aforesaid, we find that no substantial question of law is involved in the present appeal.

5. In view of the aforesaid, the appeal (CEXA/38/2017) is dismissed. All pending applications also stand dismissed.
