The Court :- This is an application for modification of the order dated 27th April, 2023 to enable the applicant, Kalpana Majumder, who is also the Administrator under the Will dated 24th September, 2019, to withdraw from the bank accounts, if necessary, along with the executor, Abhradeep Sinha that may be required for the purpose of mitigating any emergency expenses. At present there are two bank accounts, the amounts wherein are paltry. The house property which has been directed to be sold by the testator in the Will which has been probated has not yet been sold. In the aforesaid facts and circumstances, I do not find any modification of the order dated 27th April, 2023 is required at this juncture.

The application, therefore, is disposed of without any order with the liberty to the Administrator or the executor, either jointly or severally, to approach the Court as and when necessary seeking modification of the order dated 27th April, 2023 so that the money which may come from selling the immovable property at Panihati can be used and utilized for medical emergency of one of the beneficiaries who is mentally challenged.
