The Court :- This is an application for grant of probate of the last Will and Testament dated 5th October, 2012 left behind by the abovenamed deceased.

The first wife of the testator, namely, Shuvra Roy, pre-deceased the testator. Out of the first marriage there is a daughter, namely Meenakshi Roy who is the only heir in intestacy of the testator. The testator married for the second time, but such marriage was dissolved by a decree of divorce. There is no issue from the second marriage. Under the Will the daughter being the only heir in intestacy of the testator is the beneficiary along with the second wife. The daughter has given consent.

Considering the view of the department upon complete scrutiny, the application for grant of probate is allowed by granting order in terms of prayer (a) of the petition.

The petition for grant of probate stands disposed of, accordingly. (ARINDAM MUKHERJEE, J.) snn
