The Court:- The present writ application has been preferred with a prayer for revalidation of the sanctioned plan of the year 1985 in respect of premises No. 2, Church Lane, Kolkata-700001. It is submitted by the learned counsel appearing for the petitioner in presence of the learned counsel for the Kolkata Municipal Corporation that certain subsequent developments have taken place which are relevant for considering the plan for revalidation and necessary steps have to be taken by the petitioner in respect of the prayer for revalidation and accordingly, the writ petitioner prays for withdrawal of the writ petition with a liberty to sue afresh on the self-same cause of action. Accordingly, the prayer of the petitioner is allowed.

The petitioner is permitted to withdraw the writ petition and is granted liberty to sue afresh on the self-same cause of action. [SHAMPA DUTT (PAUL), J] KB
