The Court: The condition in the notice inviting tender No.SE/KP/2324/811/D/20 dated 17th July, 2024, does not preclude the petitioner from participating in the tender process. The petitioner is an enlisted (registered) contractor under category-A. Clause 3.4(d) of the General Conditions of Contract as also the Contractor's manual, allows the petitioner to participate in any tender upto the value of Rs.10 lakhs. The subject tender is valued at Rs.4,04,269.18.

Thus, I do not find any reason to interfere with the decision of the authority. The NIT does not restrict the petitioner from participating in the tender.

Accordingly, WPO/956/2024 is disposed of.
