The Court : Ld. Advocate appearing for the petitioner is present. The affidavit of service filed by the petitioner be kept with the record. The petitioner has approached this Court with a prayer for handing over the key of the room where the deceased committed suicide and wherein a padlock was affixed.
Learned Advocate for the State has submitted that the petitioner claims he happens to be owner of the house. A report has been submitted by the State which reflects that the keys were handed over to one Firdouse Parveen, wife of the deceased. Metiabruz P.S GD Entry No. 1627 dated 26.01.2024 was registered. The police authorities were prima facie satisfied with the documents submitted by the lady and as such, handed over the key of the room for which the present petitioner has approached this Court.
Learned Advocate appearing for the petitioner submits that several communications were made to the police authorities including the Officerin-Charge of Metiabruz Police Station but he was not responded. Be that as it may, as it is transparent from the report submitted by the Additional Officer-in-Charge, Metiabruz Police Station that the keys have been handed over to the wife of the deceased, I am of the opinion that the purpose for which the writ petition has been preferred for the time being no longer remains. Petitioner would approach the jurisdictional Court under the relevant provisions for appropriate relief. With the aforesaid observations, WPO/959/2024 is disposed of. Report submitted be kept with the record. A copy of the report be handed over to the learned Advocate appearing for the petitioner. (TIRTHANKAR GHOSH, J.) KB
