The Court: An undertaking filed by the defendant be kept with the records. By the undertaking, the defendant has removed all hoardings affixed in the shop and has undertaken to stop using the impugned mark in any manner whatsoever.

In view of the above, nothing survives in the suit. The interlocutory application being GA-COM/1/2024 stands disposed of in the light of the undertaking filed in Court.

By consent of the parties, the suit being IP-COM/33/2024 stands decreed in terms of prayer (a) of the plaint.
