Since Mr. Biswaroop Bhattacharya, learned advocate representing the petitioner would submit that there are formal defects in the petition and he seeks to withdraw the same and file afresh on the self-same cause of action and since Mr. Kamalesh Bhattacharya learned advocate representing the respondent nos. 5 and 6 and other learned advocates representing the respondents including the municipality do not raise any objection, let this matter stand dismissed as withdrawn with liberty to file afresh on the self-same cause of action.
