...for KMC The Court: The parties have agreed to extension of the Arbitrator's mandate. The pleadings were completed on 22nd September, 2021 and the one year under Section 29-A(1) was hence completed on 21st September, 2022. The parties agreed for the additional extension of six months under Section 29-A(3) which also got over on 21st March, 2023.

The present application has been made in July, 2023. The Court is informed that the claimant's witness is now being cross-examined. The Court is also informed that the cross-examination will require three more sittings and further five more sittings for the evidence to be complete.

Learned counsel appearing for the parties submit that the claimant's witness underwent a surgery and could only participate in the arbitration proceeding from February, 2023 onwards and further that learned counsel appearing for the respondents is presently in some difficulty. Considering the fact that both the parties seek extension of the Arbitrator's mandate and the circumstances as brought to the notice of the Court, AP No. 485 of 2023 is allowed and disposed of by extending the Arbitrator's mandate for a period of four months from today.
