.... for the petitioner The Court: Office is directed to re-register the matter as an application under Commercial Division and take steps accordingly. This is an application for appointment of a substitute Arbitrator upon the recusal of the erstwhile Arbitrator. The ground of recusal is very unfortunate. However, this Court does not wish to deliberate on the said matter further and expects the parties to cooperate with the substituted Arbitrator who shall be appointed by this Court.

Under such circumstances, the application is disposed of by appointing Mr. Debasish Roy, Advocate (M-9831173923) as the sole Arbitrator

to arbitrate the dispute. The learned Arbitrator shall comply with the provisions of Section 12 of the Arbitration and Conciliation Act, 1996. The learned Arbitrator shall be at liberty to fix his remuneration as per the Schedule of Arbitration and Conciliation Act, 1996.
