The Court :- In the last Will and Testament dated 13th April, 2015 the testatrix has stated to have a daughter by the name of Sangeeta Goenka wife of Sri Vijay Kumar Goenka a resident of 71/4, Sham Nagar Road, Dalmia House, Kolkata. The said daughter being one of the heiress in intestacy has given consent to the grant by filing an affidavit wherein she has stated her name to be Sangita Agarwal wife of Vinay Kumar Agarwal and daughter of Biswanath Kedia. The address, however, tallies with the one provided in the Will. The other heirs in intestacy of the testatrix have also given consent. The name of the husband of the testatrix is Bishwanath Kedia who is also the father of Sangeeta Goenka/Sangita Agarwal.

Considering all these, the consent affidavit given by Sangita Agarwal wife of Vinay Kumar Agarwal is accepted as a consent affidavit of Sangita Goenka and probate is granted in terms of prayer [a] of the petition.
