The Court: This is an application under Section 11 of the Arbitration and Conciliation Act, 1996. The arbitration clause has been presented before the Court.

The petitioner has submitted that the erstwhile arbitrator is disqualified under the provisions of the Arbitration and Conciliation Act, 1996. Hence this application has been filed for appointment of fresh arbitrator.

Mr. Raj Ratna Sen, Advocate is appointed as sole arbitrator to arbitrate the disputes and differences between the parties. This appointment is subject to compliance of Section 12 of the 1996 Act. Learned arbitrator shall be entitled to fix his remuneration. All objections available to either of the parties, may be raised before the learned arbitrator.

Liberty is granted to the learned Advocate-on-record for the petitioner to correct the cause title in course of today. Accordingly, AP-COM/867/2024 is disposed of.
