The matter is listed as 'To Be Mentioned' on the prayer made by the counsel for the parties on the ground that the parties have settled their disputes and have handed over a Terms of Settlement entered between the parties dated 19th November, 2024. The plaintiff has claimed the total amount of Rs.35,67,397/- along with interest @ 16% per annum till realization of the said amount.

During the settlement, parties have settled the claim at Rs.20 lakhs as full and final settlement and the defendant has paid Rs.20 lakhs

to the plaintiff by way of demand draft being no.309744 dated 18th November, 2024 of HDFC Bank, Stephen House, Kolkata-700001. Considered the submission made by the counsel for the respective parties and perused the Terms of Settlement entered between the parties. This Court finds that the parties have settled their claim for a total sum of Rs.20 lakhs and the defendant has paid the said amount by way of demand draft. Accordingly, there is no impediment to accept the Terms of Settlement entered between the parties. In view of the above, CS/249/2021 is disposed of. Decree be drawn by treating the Terms of Settlement as part of the decree. A copy of the demand draft be kept with the record. All connected applications, if any pending, are also treated as disposed of.
