The Court : The petitioner has filed the present application under Section 29A of the Arbitration and Conciliation Act, 1996, seeking extension of the mandate of the arbitral tribunal for conclusion of the arbitral proceedings and publication of the arbitral award.

Learned counsel for the petitioner, Mr. Basu contends that the sole Arbitrator was appointed by this Court vide order dated 24.11.2022 to adjudicate the dispute between the parties. With the consent of the parties, an extension for a period of six months was granted by the Tribunal on 1st February, 2024. This Court vide order dated 19.02.2025 granted further extension of six months to the Tribunal to conclude the proceedings. The mandate of the Arbitral Tribunal expired on 20th August, 2025.

Learned counsel for the petitioner further states that the matter is presently at the stage of recording of evidence of the respondent. The tribunal has held already more than 30 sittings.

None appears for the respondent, despite service. Upon consideration, this Court is satisfied that there has been no undue and unwarranted delay on the part of the Arbitral Tribunal in conducting the proceedings.

In view of the advance stage of the proceedings and in the interest of justice, this Court is satisfied that the mandate of the Arbitral Tribunal shall be further extended for a period of eight months to conclude the arbitral proceedings and publish the award.

Learned sole Arbitrator is requested to make all endeavours to conclude the proceedings and publish the award within the extended time period. With the above directions, the present application being AP/180/2025 is disposed of.
