...for the respondents The Court: - Affidavit of service filed today in Court is taken on record. The petitioner appearing in person prays, inter alia, for the following reliefs:

a) Direct Respondent No 2, 7 and 8 to Evict the private respondents/tenants/manager Respondent No 3 to 6 and others encroaching the said property under Senior Citizen Act specified of the State and thus reap profits for proper health care of the extended family; b) Direction to file FIR against the miscreants all causing nuisance in the building/ frauds and search the said premises of money laundering activity/impersonation of Rent receipts//CESC Meter Applications since long/Signature. The Courts Small Causes filed case No 1768 of 2000 in the 3rd Bench and Other typists frauds in ejectment orders,/ FIR be registered upon the Court officers of 4th Ld Judge/ Records section at the ground floor;

c) More conscionable justice to the petitioner and remove all illegality of wall shops by the Respondents No 2, 7 and 8 and collection of monies by the traffic sergeants as and so be injunct forever from 01.11.2025 (1 November 2025) as 'Corruption' mentioned in W.P.O 773 of 2024 and truck collection by in-guise men of Sergeants 'Chand' be kept free for ingress/ egress to from the Rohatgi Mansion';

(d) Writ in nature of Mandamus of Prohibition certiorari and/or such other writ or writs direction order, or orders in the aforesaid circumstances your petitioner most humble prays that your Lordship would graciously be pleased to allow this application for Urgent hearing in the light of Senior Citizen Act 2007;

(e) Ad interim orders in terms of prayers a), b), c) and d) above; (f) Costs of Rs 1,50,000 be paid by the private respondents on ground of default of Rent and causing disrespect by running away from Kolkata without any information/permission of the landlord/defamation; h) Such further and/or other order, orders be passed and/or direction or directions be given as this Hon'ble Court may deem fit and proper. The main grievance is with regard to the adjudication of the law and order by the respondent authorities by taking necessary steps to oust the tenants and hand over the keys to the petitioner/landlord in respect of the 2nd floor tenancy of the property 'Rohatgi Mansion' situated at 15, 17 & 19 Rabindra Sarani, Kolkata-700073 by the respondents/Manger/tenants No.3 and Nos. 4 to 6.

The petitioner submits that a complaint has already been lodged by the respondent No.2 on 15th October, 2025. A physical copy of the same has been filed in the Court today at the time of hearing. The State respondent appears and vehemently opposes the submissions made by the petitioner and submits that the comprehensive representation

should be made before the authority concerned for taking cognizance of the same.

Having heard the parties and perusing the materials available on record, I am of the considered view that for the ends of justice, since the petitioner appearing in person being a senior citizen shall file a comprehensive representation before the respondent No.7, a copy of the same also be served upon the respondent No.2 for taking cognizance of the same within a period of fortnight, which shall be considered within a period of thirty days thereafter upon giving an opportunity of hearing to the petitioner to arrive at a logical conclusion. If required, the police authorities shall forthwith take immediate steps in accordance with law.

The writ petition is disposed of.
