The Court :- The petitioner is the wife of respondent no.10. The respondent no.10 is an employee of Eastern Coalfields Limited (in short ECL). The respondent no.10 had availed the benefit under the National Coal Wages Agreement (NCWA) to get compassionate appointment on the death of the

father of the petitioner being his father-in-law after giving certain undertaking before ECL in favour of the petitioner. Disputes and differences have arisen between the petitioner and the respondent no.10 as a consequence whereof this writ petition was filed.

During the pendency of the writ petition, the petitioner and the respondent no.10 have entered into an out of Court settlement by signing a deed of agreement dated 16th November, 2024.

The original agreement after being stamped and punched is filed in Court and is taken on record.

I find that the agreement to be a lawful one. In the aforesaid facts and circumstances, the writ petition is disposed of by passing an order in terms of the agreement by treating the said agreement dated 16th November, 2024 as a part of the order. ECL and Coal Mines Provident Fund Organization (CMPFO) are directed to act in terms of the compromise and the order passed on the basis of this compromise.

The order should be drawn up as expeditiously as possible treating the agreement dated 16th November, 2024 as part of the order. Parties will be at liberty to mention, if necessary. The writ petition, accordingly, stands disposed of. (ARINDAM MUKHERJEE, J.) snn.
