The Court: This is an application for extension of time of the mandate of the learned Arbitrator and/or also for appointment of a substitute Arbitrator. The petitioner submits that the witness action has commenced and the proceeding is nearing completion.

Considering the submissions and the pleadings, this Court is of the view that this is a fit case for extension of time to enable the learned Arbitrator to make and publish the Award. Accordingly, the time is extended by a period of one year from the date of communication of this order upon the learned Arbitrator. The question of appointing a substitute Arbitrator does not arise.

As no affidavit has been called for, allegations against the respondent are deemed to be denied.
