For petitioner The Court : It is fairly conceded by Mr. Sahu learned advocate appearing on behalf of the applicant that this application for converting the application for grant of probate into an application for Letters of Administration on the facts as elucidated in the application is likely to lead to future complication. The petitioner, therefore, prays for withdrawal of the main application for grant of probate being PLA No.380 of 2024 and for applying afresh for Letters of Administration.

After hearing the petitioner it appears that there is substance in the submission made by Mr.Sahu.

In the aforesaid facts and circumstances, the application being PLA/380/2024 is treated as on day's list and is dismissed as withdrawn with liberty to file an appropriate application on the self-same cause. The petitioner shall be entitled to refund of the court fees and the original Will dated 10th January, 2017 annexed to the application being PLA/380/2024. GA/1/2026 is, accordingly, disposed of.
