The Court : Affidavit of compliance affirmed by the alleged contemnor on 16th October, 2023 is taken on record. Copy of the same has been served upon the learned Advocate representing the petitioner. Learned Advocate for the petitioner submits that hearing was conducted and unauthorised construction detected. Notice under Section 400(1) of the Kolkata Municipal Corporation Act, 1980 has been served upon the person responsible.

The alleged contemnor being the Executive Engineer of the concerned borough is directed to take steps for conclusion of the proceeding to deal with the unauthorised construction in accordance with law at the earliest.

It has been submitted by the learned Advocate representing the alleged contemnor that on account of shradh ceremony of the father of the alleged contemnor today, he is unable to attend the Court. In view of such submission, the personal appearance of the alleged contemnor stands dispensed with.

The contempt application stands disposed of.
