The Court :- We have heard learned advocates on either side. It appears that there is a delay of 65 days in filing the appeal. As we are satisfied with the explanation offered the delay in filing the appeal is condoned. This appeal has been filed by the revenue under Section 260A of the Income Tax Act, 1961 (the Act) challenging the order dated November 6, 2023 passed by the Income Tax Appellate Tribunal, "DB" Bench, Ranchi in ITA/32/RAN/2020 for the assessment year 2013-14.
As could be seen from the order passed by the Commissioner of Income Tax, (Appeals), as well as the Memorandum of Grounds the aggregate tax effect in this appeal is Rs.1,04,35,934/- which is well below the threshold limit prescribed by the CBDT.
