Counsel for the plaintiff has handed over a communication dated 12th February, 2025 issued by the authorized representative of the plaintiff to the advocate-on-record of the plaintiff informing that the matter has been settled between the plaintiff and the defendants and, thus, the plaintiff requested the learned counsel for withdrawal of the suit and also for refund of the Court fees.

In terms of the communication dated 12th February, 2025, learned counsel for the plaintiff prays for withdrawal of the suit as well as refund of the Court fees.

Considering the submission made by the counsel for the plaintiff and on perusal of the communication dated 12th February, 2025, CSCOM/533/2024 [Old No. CS/158/2023] is dismissed as withdrawn. As the suit has been filed in the year 2023 and now after the period of two years the plaintiff intends to withdraw the suit, this Court finds that this is not a fit case to refund the Court fees.
