...for the respondent The Court: This is an application under sections 29A(4) and 29A(5) of the Arbitration and Conciliation Act, 1996.

By an order dated 5th February, 2021, a Coordinate Bench had appointed a Sole Arbitrator to adjudicate upon the disputes between the parties. Thereafter, the Arbitrator entered upon reference on 10 February, 2021 and held several meetings. By an order dated 3rd September 2022, the Arbitrator inter alia stayed the arbitration proceedings. The said order has been challenged in an independent proceeding.

In the meantime, it is contended that the time for the Arbitrator to publish the award has expired. The respondent is represented and fairly submits that in view of the decisions of the various Courts he has no objection to the mandate of the sole Arbitrator being extended. In view of the sufficient cause and cogent reasons disclosed as to why the Arbitrator was unable to publish the award, there shall be an order in terms of prayer (a) of the Notice of Motion.

With the above directions, AP-COM/356/2024 (Old No. AP/528/2023) stands disposed of.
