1. Mr. Anubhav Sinha, learned Advocate, is appearing for the petitioner.
2. The petitioner has filed the present application for grant of Letters of Administration of the properties and credits of the deceased, Salil Kumar Chatterjee throughout the State of West Bengal.
3. Counsel for the petitioner submits that the deceased died on 7th May, 2021 and the wife of the deceased, Bani Chatterjee was predeceased who died on 16th November, 2016. The deceased died leaving behind only one son, namely, Aditya Narayan Chatterjee who is the petitioner before this Court. Counsel for the petitioner submits that publications were made and citations were issued but none has come forward for raising objection for grant of Letters of Administration to the petitioner. Accordingly, the department has issued No Caveat Certificate on
1st March, 2025 certifying that no caveat has been entered against the grant of Letters of Administration.
4. Considered the submission made by the counsel for the petitioner. Perused the death certificate of the deceased and the death certificate of the wife of the deceased.
5. This Court finds that the deceased died leaving behind one son who is the petitioner before this Court and prayed for Letters of Administration.
6. Considering the above, this Court finds that there is no impediment for grant of Letters of Administration.
7. Accordingly, the department is directed to issue Letters of Administration to the properties and credits of the deceased throughout the State of West Bengal to the petitioner subject to furnishing bond of Rs.10,00,000/- with two sureties.
8. PLA/364/2022 is disposed of.
