Challenging the order passed under section 400(8) of the Kolkata Municipal Corporation Act, 1980 the instant writ petition has been filed. 2.

The learned Counsel for the petitioner on instruction would, however, would submit that he does not wish to proceed with the instant writ petition.

The writ petition stands dismissed leaving it upon the municipality to act in accordance with law.
