The Court: Affidavit-in-reply filed in Court be taken on record. Heard counsel appearing on behalf of both the parties in the Section 9 application. It appears from the factual matrix that the Section 9 application has become infructuous and accordingly, may be disposed of without passing any further orders.

Both parties have agreed to have an Arbitrator appointed by the Court. Accordingly, Mr. Sabyasachi Chaudhury, Advocate, Bar Library Club (Mob. No.9831034562), is appointed as Arbitrator. The appointment is subject to submission of declaration by the Arbitrator in terms of Section 12(1) in the form

prescribed in the Sixth Schedule of the Act before the Registrar, Original Side of this Court within four weeks from today.

Let this order be conveyed to the Arbitrator by the Registrar, Original Side forthwith.
